<p style="font-family: inherit; color: inherit;"><strong>TERMS FOR USE OF THE RENTAL SERVICE</strong></p>
<p style="font-family: inherit; color: inherit;">Gjendesheim AS, org 896 166 042 MVA runs a rental service where companies and consumers can rent equipment for joint use by ordering the equipment online and picking up and delivering at Gjendesheim Turisthytte, Gjendevegen 200, or other places nearby (by agreement).</p>
<p style="font-family: inherit; color: inherit;"><strong>1 General</strong></p>
<p style="font-family: inherit; color: inherit;">These terms apply to the rental and sale of goods and services from https://gjendesheim.dnt.no/ to businesses and consumers. The terms and conditions, together with your order, will constitute an overall agreement for the purchase.</p>
<p style="font-family: inherit; color: inherit;"><strong>2 Definition of parties</strong></p>
<p style="font-family: inherit; color: inherit;">The lessor or seller is: Gjendesheim AS and is hereinafter referred to as we, us, lessor or Gjendesheim.</p>
<p style="font-family: inherit; color: inherit;">Tenant is: the person stated as the tenant or buyer in the order, and is referred to below as the tenant, the customer, you, you, your or your.</p>
<p style="font-family: inherit; color: inherit;">Rental objects means tools, equipment, machines and everything else that is rented out from Gjendesheim.</p>
<p style="font-family: inherit; color: inherit;"><strong>3 Payment, deposit and prices</strong></p>
<p style="font-family: inherit; color: inherit;">Payment is made via Visa or Mastercard online via our payment method DIBS, which meets the strictest security requirements. The tenant pays when ordering and then the rental agreement is recognized as having been entered into.</p>
<p style="font-family: inherit; color: inherit;">Your Company follows normal rental practices and also reserves a deposit amount as stated on the order receipt when ordering. Reservation ensures if the customer returns the tool late, damages the tool or does not deliver at all. The size of the deposit varies with the selected equipment that is rented and appears in your order confirmation. Your Company has the right to use the deposit to cover rent and other costs mentioned above and/or any recourse claims, cf. point 5 below.</p>
<p style="font-family: inherit; color: inherit;">All prices include VAT. The total cost of the purchase will appear before ordering and will include all expenses associated with rental or purchase. If there have been errors of a significant size on Your Company's part of the website, Your Company can unilaterally change, delete or reject orders even after the customer has received order confirmation or the like. However, such errors must be corrected and the customer informed within a reasonable time after the error has been discovered.</p>
<p style="font-family: inherit; color: inherit;"><strong>4 Condition of the rental property</strong></p>
<p style="font-family: inherit; color: inherit;">Gjendesheim undertakes to deliver high-quality rental properties in a ready-to-operate condition. Your Company has its own routines that check and maintain the rental properties before and after rental.</p>
<p style="font-family: inherit; color: inherit;">During the rental period, you are responsible for all damage or loss to the equipment. Exemption from liability can occur if the damage or loss is due to technical errors or deficiencies. The tenant is therefore obliged to check the rental object before use and to contact Your Company if the rental object is not in the expected condition.</p>
<p style="font-family: inherit; color: inherit;"><br /><strong>5 Injuries</strong></p>
<p style="font-family: inherit; color: inherit;">All damages, technical errors or accidents that may occur during the rental period must be reported to Your Company immediately. We will then do our best to help the tenant. Damages must be reported to support@yourcompany.no immediately. This also applies to theft.</p>
<p style="font-family: inherit; color: inherit;">If the damage occurs due to incorrect use, intentionality or negligence, Your Company will be able to use the previously reserved deposit and, if necessary, deduct additional outstanding amounts to cover the costs associated with repair, service or replacement of the tool. This also applies if the equipment is delivered back in its original condition or is delivered dirty beyond normal.</p>
<p style="font-family: inherit; color: inherit;">We always strive to give the best advice and tips for the use of the rental object, but are not responsible for execution or for direct or indirect damages or losses due to the use of the rental object, delays or faults on the rental object.</p>
<p style="font-family: inherit; color: inherit;"><strong>6 Use of the rental object</strong></p>
<p style="font-family: inherit; color: inherit;">Use of rental properties is at your own risk. Anyone using the equipment must be over 18 years of age.</p>
<p style="font-family: inherit; color: inherit;">The tenant is responsible for equipment and accessories being used in such a way that they are not damaged or unreasonably soiled. Correct and safe use of the equipment is the Lessee's responsibility. The Lessor facilitates the correct use of the equipment by making user manuals, instructions and safety procedures available together with the tool and/or on the Lessor's website. It is the customer's responsibility to familiarize themselves with the Lessor's use and safety routines before using the equipment.</p>
<p style="font-family: inherit; color: inherit;">We recommend the use of protective equipment. You must also follow the equipment's user manual and other instructions from Gjendesheim.</p>
<p style="font-family: inherit; color: inherit;"><strong>7 Accessories</strong></p>
<p style="font-family: inherit; color: inherit;">Accessories must, as a general rule, be bought or rented separately when ordering the tool and selected according to the task the tenant wants to perform on the website. The website also describes what is included in the delivery of the rental object. In addition, safety equipment is required in a number of situations and is offered on the website. Accessories that are personal (dust masks etc) or consumables that wear out (saw blades etc) are not rented out. Clause 12 Right of withdrawal applies to accessories that are sold and have not been put into use.</p>
<p style="font-family: inherit; color: inherit;"><br /><strong>8 Tenant's rights and obligations</strong></p>
<p style="font-family: inherit; color: inherit;">The tenant must be 18 years of age and must provide correct customer details when creating a user account in order to order and rent on yourcompany.no. Your Company sends messages to the specified e-mail, address and telephone, and such messages are considered received and valid when sent by us.</p>
<p style="font-family: inherit; color: inherit;">The user account is personal and if you suspect that others have access to your account, you must notify Your Company immediately. Your Company has the right to freely reject, terminate or suspend the user account without notice or liability, including if the terms are deemed violated.</p>
<p style="font-family: inherit; color: inherit;">Furthermore, these rental terms must be accepted before ordering on the website.</p>
<p style="font-family: inherit; color: inherit;">The lessee must return the rental object before the agreed date and time expires and in the agreed form of delivery. The tenant is expected to keep up to date on the service point's normal opening hours.</p>
<p style="font-family: inherit; color: inherit;">The tenant or cardholder authorizes Your Company to make credit card instructions for, among other things, rental objects that are not returned, are dirty beyond normal or in the event of damage to the rental object. The authorization thus granted also applies to the authorization to charge the payment card for additional rent/claims for compensation if the rental object is returned after the end of the agreed rental period or is returned with errors or defects.</p>
<p style="font-family: inherit; color: inherit;">Delay in returning the tool for more than 1 - one - hour in relation to the agreed rental period entitles the lessor to one day's extra rent as well as a supplement, currently NOK 300, which covers additional expenses Your Company incurs due to late delivery . If the rental object is not returned after one day, Your Company is entitled to be reimbursed the agreed daily price as long as the tool is actually disposed of and has not been returned by the lessee.</p>
<p style="font-family: inherit; color: inherit;"><strong>9 Change of order</strong></p>

<p>To change an order, Your Company must be contacted. The changes will not be valid until they have been confirmed in writing by us. This is to ensure that the rental properties are actually available. Unless otherwise agreed and confirmed, the rental object must be returned at the agreed time. Extension of the rental period can take place before the start of the rental period and/or during the rental period by changing the rental start or rental end.</p>
<p style="font-family: inherit; color: inherit;">Changes and cancellations of rental objects that cause the availability of the rental objects for other users to change may be associated with a change fee to cover the costs of rebooking. The change fee is currently NOK 300. All costs will be disclosed to the tenant before placing an order or changing the order.</p>
<p style="font-family: inherit; color: inherit;"><strong>10 Delivery and return</strong></p>
<p style="font-family: inherit; color: inherit;">Delivery and return takes place in the manner, at the place and at the time indicated on the order confirmation. You can also find it under your page. We are responsible for the products until they are taken over by you, i.e. when you have received the products in your possession. In order to have the rental object handed over, you must have your booking reference. The name you enter on the reservation must match the name on the ID card upon collection.</p>
<p style="font-family: inherit; color: inherit;">If the delivery of the rental objects is delayed, we will give you information as soon as we are aware of it, together with information about and possibly when delivery can take place, or if the product(s) are sold out or the rental object(s) are not available.</p>
<p style="font-family: inherit; color: inherit;">You are responsible for the product until it is returned to us or our service points.</p>
<p style="font-family: inherit; color: inherit;">We check the condition and function of the rental objects and that all parts are present when they arrive at our warehouse. In the case of complete delivery in contractual condition, the reservation for the deposit on the payment card is deleted.</p>
<p style="font-family: inherit; color: inherit;"><strong>11 Membership</strong></p>
<p style="font-family: inherit; color: inherit;">Membership entitles you to reduced prices and other member benefits. Both private individuals and businesses can be members, but it is the person who is registered who is legally responsible and party to the agreement.</p>
<p style="font-family: inherit; color: inherit;">Membership is automatically renewed until it is terminated by the tenant. It ends on the account page by stopping the subscription. The membership will then expire the current period and then end.</p>

<p style="font-family: inherit; color: inherit;"><strong>13 Intellectual property rights</strong></p>
<p style="font-family: inherit; color: inherit;">The content and the service are protected by the Copyright Act. Image material stored on the page has been obtained with permission from the rights holders. Videos on YouTube are links to third-party services beyond Your Company's control.</p>
<p style="font-family: inherit; color: inherit;"><strong>14 Privacy</strong></p>
<p style="font-family: inherit; color: inherit;">Your Company processes your personal information in a secure data register in order to be able to fulfill its obligations and safeguard its rights in accordance with the lease agreement. The personal data processed are name, address, telephone number, e-mail address and order history. This history will remain stored for accounting and other obligations. All stored information is available in "My account". The tenant has the right to have their personal data removed from the Landlord's systems, which is done by contacting Your Company in person.</p>
<p style="font-family: inherit; color: inherit;">Your payment card will be stored as long as you have an active order. The payment card is stored at our payment intermediary DIBS. They store the information in a safe and secure manner. Saving payment cards makes it even easier when shopping. You can delete payment cards on your page. Your Company does not store any credit card details itself.</p>
<p style="font-family: inherit; color: inherit;">Your Company uses cookies, like most other online stores. Cookies store data in your browser so that the website can recognize you from page to page and visit to visit. We can then recognize who you are so that, among other things, you can get the correct prices and easier login. We also collect usage information to improve the quality of the service.</p>

If Your Company considers that the changes in the terms and conditions are significant in relation to the tenant's rights or obligations, the changes will be made available on yourcompany.no 30 days before they come into force.</p>
<p style="font-family: inherit; color: inherit;">By using the service after the changes to the terms have been made available on yourcompany.no, you agree to be bound by the updated terms. If you do not wish to accept the new terms, you may not use Your Company.</p>
